Terms of Use

for the ChessLynx app

1. Provider, scope, contracting party

These terms apply to the ChessLynx app (the “App”) by CMZen Digital, owner Christian Mäusezahl, Grafinger Straße 113, 81671 Munich, Germany (“CMZen Digital”). The contracting party is the parent or legal guardian who sets up the App or creates a parent account, not the child. The terms of Apple’s App Store, including its Standard Licensed Application End User License Agreement, or of Google Play apply in addition.

2. Target group and parental responsibility

The App is intended for children aged 5 and up and is designed to be usable without reading. The parent area is protected by a parent gate. Parents decide whether and for how long their child uses the App and accompany its use.

3. Services

The welcome story and the first three adventures, in which the child gets to know the pawn, rook and bishop, are free of charge. The one-time “Full learning path” unlock opens the App’s further adventures and exercises, including the companions’ territories with tactics tasks, games against computer opponents and puzzles. The exact scope is shown in the App and in the store listing. The App works without an account and without an internet connection; a parent account is only needed for the purchase and for backing up progress.

4. Price and payment

The unlock is a one-time purchase, not a subscription. At launch it costs €9.99 or US$9.99 (until and including January 31, 2027), and €14.99 or US$14.99 thereafter. The price shown by the store at the time of purchase is binding; in other countries it may differ in local currency. Payment is handled exclusively by Apple or Google. The purchase applies to the parent account in which it was verified and to all child profiles in it. It is available on every device where this parent account is signed in; with the same Apple ID or Google account it can also be restored via “Restore purchases”. A purchase always belongs to exactly one parent account: if it is restored in a different parent account, the unlock moves to that account and the previous account loses it. Apple Family Sharing is not enabled for the unlock.

5. Withdrawal and refunds

The purchase is concluded via Apple’s App Store or Google Play. Withdrawal and refunds are governed by their rules and handled through their refund procedures. Statutory rights remain unaffected.

6. Parent account

Anyone creating a parent account must be of legal age, provide their own email address and keep their login details secret. The account can be deleted at any time in the parent area; after entering the password and a two-step confirmation, deletion is immediate and final. A purchase already paid for is not refunded as a result, but can be restored via the store.

7. Progress backup

With a parent account, progress is backed up whenever a parent opens the parent area and is thereby synchronised with other devices of the same account. Progress made since the parent area was last opened is stored only on the device and may be lost if the device is lost or the App is reinstalled. “Reset progress” applies to all devices of the account.

8. Time limit

A daily time limit can be set in the parent area (15 minutes by default). When it is reached, the App pauses for that day until a parent extends it in the parent area. The time limit is enforced on the device and can be circumvented technically (for example by changing the device clock or reinstalling); this is not a defect of the App.

9. Rights of use and intellectual property

CMZen Digital grants a simple, non-transferable right to use the App for private, non-commercial purposes. The rights in the content of the App, in particular the mascot “Lux”, the animal illustrations, texts, voice recordings and the ChessLynx logo, belong to CMZen Digital to the extent that any rights subsist in them. “ChessLynx” and the character “Lux” are trademarks of CMZen Digital (not yet registered); CMZen Digital claims all rights in them, including the rights in the title of the app. Registration is planned. The App may not be modified, reverse-engineered or distributed outside the stores unless the law permits otherwise. Third-party content and software components are listed with their licences under “Credits” in the App and at https://chesslynx.com/en/licenses/.

10. Updates

CMZen Digital provides the updates necessary to keep the App in conformity with the contract, including security updates (§ 327f BGB), and informs about them via the update function of the respective store. The supported operating system versions are stated in the store listing.

11. Liability

CMZen Digital is liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. In cases of slight negligence, CMZen Digital is liable only for breach of essential contractual obligations and limited to the foreseeable damage typical for the contract. Constant, uninterrupted availability of services that require an internet connection (parent account, backup, purchase verification) is not owed.

12. Changes to these terms

CMZen Digital may change these terms with effect for the future if changes in the law, case law or technical circumstances require it and the change is reasonable for parents. We inform about material changes in the parent area of the App.

13. Applicable law, dispute resolution, final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the parents have their habitual residence remain unaffected. CMZen Digital does not take part in dispute resolution proceedings before a consumer arbitration board. If any provision is invalid, the remainder remains valid.
